The paper analyzes a recent judgment of the State Council on the protection of cultural heritage. Drawing upon the analysis of this decision, it reconstructs the relationship between the competencies of the State and of the Regions and the Municipalities in this delicate matter after the reform of Title V of the Constitution of 2001, with a look - in conclusion – at the possible implications of the draft Constitutional reform approved by the Parliament in April 2016.
